pour 2010 (codifi\u00e9 \u00e0 l \u2019article 1498 bis du CGI) pr\u00e9voit la r\u00e9vision des valeurs locatives des locaux professionnels et en d\u00e9fini les nouvelles r\u00e8gles de fixation.<\/strong>\u00a0La valeur locative des locaux professionnels sera d\u00e9sormais d\u00e9termin\u00e9e \u00e0 partir de grilles tarifaires refl\u00e9tant l\u2019\u00e9tat du march\u00e9 locatif local. Ces grilles tarifaires devront \u00eatre mises \u00e0 jour chaque ann\u00e9e \u00e0 partir d\u2019une collecte des loyers :<\/p><ul><li>effectu\u00e9e directement aupr\u00e8s des propri\u00e9taires des locaux la premi\u00e8re ann\u00e9e de mise en place de la r\u00e9vision ;\u00a0<\/li><li>d\u00e9clar\u00e9s par les professionnels qui les occupent les ann\u00e9es suivantes.<\/li><\/ul><p>Ce dispositif est appel\u00e9 la \u00ab mise \u00e0 jour permanente \u00bb des loyers.<\/p><h2>PRINCIPES L\u00c9GISLATIFS (ARTICLE 1498 BIS ET ARTICLE 37 DE LA LOI DE FINANCES 2012) :<\/h2><p>Support de l\u2019obligation d\u00e9clarative : la d\u00e9claration de r\u00e9sultat (d\u00e9mat\u00e9rialis\u00e9e);<\/p><p>Contenu de l\u2019obligation d\u00e9clarative : les informations relatives \u00e0 chacun des locaux dont les professionnels sont locataires au 1er janvier de l&rsquo;ann\u00e9e de d\u00e9p\u00f4t de la d\u00e9claration de r\u00e9sultat. Il s\u2019agit principalement du loyer annuel de chaque local.<\/p><h2>D\u00c9BUT DE L\u2019OBLIGATION D\u00c9CLARATIVE : \u00c0 COMPTER DU 1ER JANVIER 2015<\/h2><p>Afin que la DGFiP puisse correctement identifier les locaux pour lesquels les loyers auront \u00e9t\u00e9 d\u00e9clar\u00e9s, il est imp\u00e9ratif que les usagers utilisent un num\u00e9ro propre \u00e0 la DGFiP dit \u00ab num\u00e9ro invariant \u00bb. Ce num\u00e9ro doit \u00eatre \u00e0 la disposition des usagers en amont.<\/p><p>Tout ceci n\u00e9cessitait la mise en place d&rsquo;un nouvel outil \u00ab\u00a0EDI-REQUETE\u00a0\u00bb puisqu&rsquo;il y aura, dans le cadre de la r\u00e9vision fonci\u00e8re, une obligation pour les entreprises de d\u00e9clarer leur loyer via Edi-TDFC. Cette proc\u00e9dure permettra \u00e0 l\u2019entreprise de demander en amont une information \u00e0 l\u2019administration (\u00e0 minima ce num\u00e9ro invariant) par l\u2019interm\u00e9diaire du PED, puis l\u2019administration renverra un message vers l\u2019entreprise contenant les num\u00e9ros invariants et \u00e9ventuellement d\u2019autres informations (par exemple : la ROF).<\/p><p>Cette proc\u00e9dure est utilisable par toute entreprise, cabinet d\u2019expert-comptable ou OGA.\u00a0<\/p><p>La DGFiP, par souci de s\u00e9curisation et de contr\u00f4le optimal, a d\u00e9l\u00e9gu\u00e9 les responsabilit\u00e9s de transfert et de contr\u00f4le des t\u00e9l\u00e9transmissions, \u00e0 des centres relais : les Partenaires EDI-DGFiP (PED), dont le portail ASPOne.fr fait partie.\u00a0<\/p><p><strong>Le portail ASPOne.fr vous propose \u00e0 ce titre, sa solution s\u00e9curis\u00e9e EDI-REQUETE pour effectuer vos d\u00e9clarations et r\u00e9ceptionner les informations directement de l\u2019Administration fiscale.<\/strong><\/p><p><strong>Votre portail vous propose une solution EDI \u00e0 partir d\u2019un logiciel agr\u00e9\u00e9, ou via l\u2019offre\u00a0<a href=\"https:\/\/www.aspone.fr\/index.php\/web-declarations\/\">Web-D\u00e9clarations<\/a>\u00a0int\u00e9gr\u00e9e au portail permettant la saisie en ligne de la requ\u00eate, et la g\u00e9n\u00e9ration automatique du formulaire
